The Placement Decision, Decoded

The school wants to move him. To the self-contained room down the hall, to a program in another building, to a separate school across town, or onto a shorter day until he settles. It came in a phone call, a hallway, or a meeting notice that says annual review. Nobody explained who decides, what you are entitled to see, what the paper has to say, whether you can say no, or what happens if you do.

The Placement Decision, Decoded is a parent's playbook for that one proposal. It starts with the word itself: the U.S. Department of Education's longstanding position is that placement means the program your child receives, not the room he sits in. From there it walks the rules the placement group must follow (34 CFR 300.116, rule by rule, each turned into a question you can ask), your seat in that group and its honest limit, where the placement lives inside the IEP, the seven things the prior written notice must say, the data a proposal has to rest on, where federal law asks for your consent and where it does not, the revocation trap to avoid, the three dispute routes, and what stay-put really protects and when it starts. Special cases get their own chapter: the shortened day, the behavior move, the separate school the district proposes, the 504 student, and a mid-year move to a new district. Ten states get their own chapter, because some of them give you more than the federal rule does: consent, objection windows, and notice days, each cited to that state's own rule.

This is general information about how the placement process works under federal law and ten states' rules. It never tells you which setting your child needs, and it never treats the school as an opponent: the school is a team you keep working with for years.
